These Terms of Use ("Terms") form a legally binding agreement between you and Andrej Miklos, operating under the AlienXcode trade name and trademark ("AlienXcode", "we", "us", or "our"), regarding your use of the AlienXcode website, PowerProfileManager, and related services.

By accessing the website, downloading the Software, or using related services, you agree to these Terms.

1. License and Software Use

PowerProfileManager is licensed, not sold.

Subject to compliance with these Terms and the applicable End User License Agreement (EULA), you are granted a limited, non-exclusive, non-transferable license to install and use the Software for personal or internal business use.

Use of the Software may also be governed by the separate installer EULA presented during installation or distribution.

2. Acceptable Use

You agree not to:

• reverse engineer, decompile, disassemble, or tamper with the Software except where permitted by applicable law,
• bypass licensing, activation, update, or security systems,
• redistribute, resell, sublicense, lease, or commercially exploit the Software without authorization,
• use the website or Software for unlawful purposes,
• interfere with the operation, security, or integrity of the website or Software,
• or infringe upon the rights of AlienXcode or third parties.

3. Intellectual Property

All Software, website content, branding, logos, trademarks, designs, source code, and related intellectual property remain the exclusive property of AlienXcode and/or its licensors.

These Terms grant usage rights only and do not transfer ownership of intellectual property.

4. Updates and Availability

Updates, patches, or feature modifications may be provided for security, compatibility, reliability, licensing, or operational purposes.

Certain functionality or services may change, be suspended, or become unavailable without prior notice.

5. System Configuration and Hardware Disclaimer

PowerProfileManager uses operating-system and manufacturer/OEM-exposed settings and does not intentionally provide hardware overclocking functionality.

The Software does not intentionally bypass firmware, thermal, voltage, power-delivery, or manufacturer safety limitations.

Users are solely responsible for applying settings appropriate for their hardware configuration, cooling environment, firmware configuration, and usage scenario.

AlienXcode is not responsible for hardware damage, overheating, battery degradation, reduced component lifespan, instability, firmware conflicts, or component failure allegedly resulting from:

• OEM firmware behavior,
• BIOS settings,
• third-party drivers,
• operating-system updates,
• manufacturer utilities,
• hardware limitations,
• or user-applied system configuration changes.

6. Crash Diagnostics and Technical Data

PowerProfileManager may generate technical crash diagnostics and debugging information to improve reliability and stability.

Crash reports are not automatically transmitted without user knowledge. Where applicable, users may review and approve crash report submission before diagnostic information is sent.

7. Third-Party Platforms and Services

If the Software is obtained through Microsoft Store or another third-party platform, additional platform-specific terms, billing rules, refund policies, and service conditions may apply.

AlienXcode is not responsible for third-party platform availability, payment systems, or external service interruptions.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the website, Software, and related services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

AlienXcode does not guarantee uninterrupted operation, compatibility with all hardware configurations, or error-free functionality.

9. Limitation of Liability

To the maximum extent permitted by law, AlienXcode shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the website, Software, or related services.

Where liability cannot legally be excluded, liability shall be limited to the amount paid for the Software, if any, as permitted under applicable law.

10. Governing Law

These Terms are governed by the laws of Spain, without limiting mandatory consumer protection rights applicable in your jurisdiction.

Any disputes arising under these Terms shall be subject to the competent courts of Spain unless otherwise required by applicable law.

11. Changes to These Terms

AlienXcode may update these Terms periodically for legal, technical, operational, or product-related reasons.

Continued use of the website or Software after updates constitutes acceptance of the revised Terms where permitted by law.
