END USER LICENSE AGREEMENT (EULA)

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY. BY INSTALLING, COPYING, ACCESSING, OR USING POWERPROFILEMANAGER (THE "SOFTWARE"), YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.


1. PARTIES

This Software is licensed by Andrej Miklos, operating under the trade name and trademark "AlienXcode" ("Licensor", "we", "us", or "our"), to you ("Licensee", "you", or "your").

2. LICENSE GRANT

Subject to your compliance with this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, terminable license to install and use the Software on compatible Windows 10 and Windows 11 devices for personal or internal business use.

This Agreement grants a license to use the Software and does not transfer ownership of the Software or any intellectual property rights.

3. ACTIVATION, TRIAL, AND LICENSE KEYS

3.1 The Software may include a time-limited trial period.

3.2 Continued use after trial expiration may require a valid activation key, account entitlement, or purchase verification.

3.3 License keys, activation credentials, and entitlements are confidential and may not be shared, resold, sublicensed, transferred, or publicly distributed.

3.4 Licensor may suspend or terminate licenses obtained through fraud, payment disputes, unauthorized redistribution, abuse, or violation of this Agreement.

4. STORE AND WEBSITE DISTRIBUTION

4.1 If the Software is obtained through Microsoft Store or another third-party marketplace, billing, refunds, updates, and platform-specific rights may also be governed by the applicable platform terms.

4.2 If the Software is obtained directly from Licensor's website or distribution channels, commercial terms and refund policies are governed by Licensor.

5. REFUND POLICY

For purchases made directly from Licensor, refund requests may be accepted within seven (7) days of purchase, subject to applicable law, fraud prevention review, and payment processor limitations.

Platform purchases may be subject to the applicable platform's refund rules.

8. SYSTEM-LEVEL OPERATIONS

8.1 The Software may require administrator privileges and may modify Windows power, performance, thermal, connectivity, startup, battery, display, sleep, or privacy-related settings.

8.2 Changes applied through the Software may affect device behavior, fan activity, thermal output, performance characteristics, responsiveness, battery life, sleep behavior, or hardware functionality.

8.3 The Software modifies operating-system and manufacturer-exposed settings at the user's direction. Licensor does not guarantee improved performance, battery life, thermal behavior, stability, or compatibility on all hardware configurations.

8.4 You are solely responsible for reviewing, applying, and validating settings appropriate for your device and usage scenario.

8.5 The Software is designed to use operating-system and OEM/manufacturer-exposed configuration ranges and settings only.

8.6 The Software does not intentionally provide hardware overclocking functionality and does not intentionally bypass firmware, thermal, voltage, power-delivery, or manufacturer safety limitations.

9. HARDWARE, DRIVER, AND THIRD-PARTY SOFTWARE DISCLAIMER

Certain features depend on hardware capabilities, firmware, BIOS configuration, chipset support, device drivers, operating-system configuration, and manufacturer limitations.

Licensor does not guarantee that all features will be available or function identically across all devices.

Licensor is not responsible for hardware damage, instability, reduced component lifespan, overheating, battery degradation, reduced performance, firmware conflicts, driver failures, data loss, or component failure allegedly resulting from device configuration changes, OEM firmware behavior, firmware or BIOS updates, operating-system updates, OEM utilities, manufacturer utilities, third-party drivers, antivirus software, hardware limitations, third-party applications interacting with the Software, or user-applied settings.

Users remain solely responsible for evaluating settings appropriate for their hardware configuration, firmware state, cooling solution, and usage environment.

To the maximum extent permitted by law, the Software is used at your own risk.

10. UPDATES

Licensor may provide updates, patches, compatibility improvements, feature modifications, or security updates. Certain updates may be required for licensing integrity, compatibility, reliability, or security purposes.

11. INTELLECTUAL PROPERTY

The Software, including all associated copyrights, trademarks, trade secrets, designs, source code, interfaces, branding, and related intellectual property rights, remains the exclusive property of Licensor and/or its licensors.

"AlienXcode" and related branding elements are protected trademarks and may not be used without authorization.

12. PRIVACY

The Software may process technical or licensing-related information necessary for activation, fraud prevention, diagnostics, updates, or operation, including device identifiers, machine fingerprints, operating system version, application version, crash diagnostics, and license status information.

Most power-management functionality operates locally on the user's device.

Crash reports or diagnostic information are not automatically transmitted without user knowledge.

Where applicable, users may review and approve crash report submission before any diagnostic data is sent.

13. TERMINATION

This Agreement remains effective until terminated.

The Agreement automatically terminates if you materially violate its terms.

Upon termination, you must cease all use of the Software and remove all installed copies from your devices.

Sections intended to survive termination, including intellectual property, warranty disclaimers, and limitation of liability provisions, shall remain in effect.

14. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

LICENSOR DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, OR ERROR-FREE OPERATION.

LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION, COMPATIBLY WITH ALL HARDWARE CONFIGURATIONS, OR WITHOUT DEFECTS.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, GOODWILL, DEVICE FUNCTIONALITY, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SOFTWARE.

LICENSOR'S TOTAL AGGREGATE LIABILITY ARISING FROM THE SOFTWARE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

16. EXPORT AND COMPLIANCE

You agree to comply with all applicable laws and regulations, including export control, sanctions, and technology-use restrictions applicable in your jurisdiction.

17. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of Spain, without regard to conflict-of-law principles, except where mandatory consumer protection laws provide otherwise.

Any disputes arising from this Agreement shall be subject to the competent courts of Spain unless otherwise required by applicable law.

18. CHANGES TO THIS AGREEMENT

Licensor may update this Agreement for new versions, legal compliance, feature changes, or operational requirements.

Updated versions may be presented during installation, update, activation, or through accompanying documentation.

Continued use of the Software after updates constitutes acceptance of the revised Agreement.
